currently using an old android phone with 4.1.2 Jellybean stock rom because recently my phone got stolen a month ago (currently saving money to buy a new one)
and pokemon go just released yesterday in my country and i want to play it so bad but it requires a Kitkat, so will it play if i upgraded my jellybean to kitkat if i install a custom rom for it?
Is the rom kk based?

To expand on this apps are built for a certain API level in android, somewhat related to the Android version number.
Pokémon Go is targeted for API 19, Android 4.4 Kitkat. So if your rom is based off of Kitkat AOSP code, you should be good to go.
Also make sure you know what you're doing if you're installing custom roms
