Can niantic even ban us?

is downloading and playing pokemon go from an appstore from another country even forbidden? i've been curious and did some research, and all i found were articles explaining how to switch countries, but not if it's allowed. all i know is, that you cant buy stuff, but you can download free apps.
I have read parts of the terms and conditions of the US appstore: http://www.apple.com/legal/internet-services/itunes/us/terms.html
and those of pokemon go: https://www.nianticlabs.com/terms/pokemongo/en
the only things that sounds interesting were the following (irst appstore, second pokemon go terms):

By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list.

i live in germany, and my english is kinda rusty, but could someone tell me, if this is relevant to the topic?
i just think, that if liantic bans people, these people should have done something against their terms and conditions. What do you think?
