If they sell it, they'll sue you. If you don't sell it, the won't give a fuck, like with all the other fan-games.
Unless you mean an original game that plays like Pokemon but doesn't use or reference anything from it in any way. In which case, ehh, Pocket Mortys got away with it I guess.

There are plenty of games that focus on collecting monsters. Shin Megami Tensei, Ni No Kuni, Dragon Quest Joker, Digimon, Yokai Watch etc. You can just make another entry in the genre instead of begging to get sued/C&D
