No, there's no such legislation in the EU saying as such.
It's simply a rumor.
The reality is that people use the micro usb cable as the norm because it's cheap and easy to package.
Anyway, the reason Nintendo didn't put a charger in is because
1) The New 3DS was meant for early adopters of the system who needed a new one due to the screen groove issue on the first model meaning they would have already had a charger
2) it would have put more of a cost on them and the userAt the very least it isn't proprietary memory cards like another system
