Pretty sure you can with a 3DS that has old firmware. Haven't tested it on mine but it was working when ORAS came out.

But, ffs, if you get access to Homebrew just downgrade and set up an emunand. This way you won't need to ask nothing about

I'll test it when I get home later tonight but I know I could inject into XY and then trade to ORAS the old, un-updated one.

Cubic Ninja apparently allows you to do something too. Not sure how that works. Haven't tried it.
