again, taking down an individual branch/download isn't any kind of sign of apocalypse or btfo, it does sometimes just occur - i've had it happen with one of the fanprojects i'm involved in and the game is still kicking, with the sole difference being one download mirror not working
that doesn't mean a c&d will never happen, but it isn't a sign of it getting closer. if a company wants to c&d, they just go all out on it right away.

They usually let them be. That is until they decide to do something similar themeselves.
Good example was Pokedexes on Appstore. There were plenty of them during late IV-early V. But they were all taken down when Nintendo decided to put Pokedex 3D Pro on mobile for money.

Nintendo is really protectionist about their work.
For instance, you can even get a YouTube account taken down for uploading Super Mario World romhacks.
But, it depends on the franchise anyways. For example, I have never seen any legal action against Mother fan content, and there is plenty of it around there.

A real pity, considering that half of a series success is making the fans to fill the void gaps in their fictional worlds with their theories. But intellectual property is a thing and they're in all their right to do so.

DMCA takedown requests can be sent by literally anyone, they don't even have to be affiliated with the copyright holders.
A Cease and Desist is something to worry about.

The issue are the assets. When I tried to make an original game, I had lots of trouble because in my small team we were just 3 programmer specialists.
We managed to make some assets because I know a little about 3D modelling and the other knows a bit of pixel art.

The result was playable, but I think we could have done much better.

Fairly sure that his actual license gives him the rights to put it on youtube, but that he messed up while actually uploading the videos. The channel should have been restored when he sent feeback about it though, but didn't. That might be more Youtube's fault than Nintendo's though.

From what I have seen Etheral Gates uses completely original assets. So if they ever did get in any bigger trouble they would just have to change some copyrighted names here and there.

It's easier to rearrange the game to make a new, "Not Pokemon" game then. As long as there are no trademarks involved, they should be fine, even if the public knows.

For example, the Chinese Pokemon game doesn't use any trademarks in a completely strict standpoint. You can say to a lawyer that Pokemon was just an "inspiration" for the girl costumes they use in that game.

You can't license, for example, a green pattern with a yellow stroke with rings at the middle, even if it's Rayquaza's model.
