What damages? Releasing the assets isn't what will have caused the damages, and Shwig's legal team would have a DAMN hard time proving that what caused any damage was the leaked assets and not Shwig's own behavior. HBomb's account is at the very least factually accurate to a certain degree - Shwig DID take the money and fuck off in an incredibly underhanded way, and held onto the art assets so he could kill an immediate competitor. He can try to sue HBomb for that, but libel/slander lawsuits only succeed when there's no truth to what's being said, and we can already see that HBomb's account has some truth.
No one who's going to pay Shwig now isn't going to let this "leak" stop them. There is no damage to Shwig's business because the assets were leaked. All the damage done was caused by his shitty way of leaving the project. And that's the sticking point that will turn any sort of lawsuit into a drawn out legal battle. And with Shwig's rep in the shitter, he's going to have a lot less cash flowing in. He doesn't have the time, or the money, to deal with an international legal battle.

But the facts don't REALLY speak to that narrative. Shwig did knowingly start another project to undermine this one when he was supposed to be working on this one. He did not gracefully leave the project because of differences on how things should go and he intentionally killed it. All the money those fans put in has gone to waste. Which is asinine - if he didn't want to work on it anymore, that's fine. But he also made it so HBomb couldn't finish it either. Which tells me he doesn't care about those fans.

The art director/lead was given an extremely generous contact at the project's inception, since they didn't think it'd be big.
Three years later, it turns out that it's huge. Art guy, for some reason, decides to secretly work on a new game and even gets people working on the current game to work on his new game in secret. When faced with increasing suspicion, he took half the project funds, and used the contract he had to essentially forbid them from using assets he made. He made or worked on a large number of assets, ergo they just lost -all- their progress.
The guy in charge is absolutely pissed and depressed, and essentially gives up on the project while releasing the files into the wild.

Yeah, Breeding Season really went downhill as it updated. I kept seeing places where there was potential, where eventually there WOULD be something, but the actual game loop was almost nonexistent.
And frankly, even if all of that content had been in place, it wouldn't have been a great game. Not as much as a highly-refined original BS would have been.
Frankly, the dev could probably still salvage the product. Just go back to basics, scrap everything but the core mechanics, and start back up with the flash assets again until the game's finished and you can hire an artist to go over it all.
