Technically yes. But it's not like you can buy a new n64 cart from a developer anymore.

In theory, yes. But nobody fucking cares as long as they don´t make money from them anymore. So with Re-releases e.g. Nintendo it´s kind of a weird legal spot. It´s a grey zone in my country, as I can legally own a "security copy" of my games, movies, etc.

Well people aren't going to be playing non pirated games on an emulator so that's essentially a moot point.
I see it as piracy only if the game is still easily available today.
Like VC games or PSN classics.

Emulation is not piracy in and of itself. I can put in my SoTC disc in at any time and play it like that.
Piracy is illegitimate distributed copy of a virtual product.
So is playing emulated "backups" piracy? Yes.
Is it in any way a real crime practically and does anyone care? No. Not morally, not even legally in practice ( no one is going to chase you down for pirating a 15 years old game).
There's also another grey area which is copies of a game sold by a company other than the developer's. For example, VtM:B was developed by a now defunct studio, therefore you are not supporting anyone but Activision who owns thw rights and shows no willingness to revive the franchise.
Theoretically, you are giving money to a publisher that actively sells the game. Therefore legally it's piracy and punishable. Is it morally bad? Arguable. For me it isn't. Why give money to someone who is not gonna give me any more content for it simply because they own the license?
