Nintendo makes the real Mother 4
In the states it would just be called Earthbound 3
In Japan it would just keep the Mother 4 title because Japan probably doesn't care for an American fangame.
But on a different scenario, Nintendo can do a cease a desist on the fan creators whenever, even now if they felt like it but right now they don't see the fan game as something detrimental to a brand they are not thinking of reviving any time soon.
