I don't think the video was protected by fair use though, the video didn't really have a big change from it's source material and it wasn't making a point about Mario Kart, the big question though is if it was monetized or not, the video wasn't fair use, ut even then Nintendo wouldn't other going after it, so that means that the video was either monetized, or Nintendo just felt like exsercising their rights one day
