It's not the first time it's happened either, their recent Neo Geo X retro console used FB Alpha and OpenDingux, seemingly without any of their respective group's authorization. At least in this case there they had some sort of official agreement with Gametap back in the day, the issue is what type of agreement they had for its use and who kept the rights after it went belly up, not that Gametap can do anything about it anymore or that SNK cares either.
