Fair use doesn't give you right to do anything. It's just intended for the basics for educational content and creating your own, original content where they just happen to appear.
I believe Nintendo can do nothing about Project M, if they just send a C&D. The team could just remove Roy, Mewtwo and some stages and alternative costumes, I don't think it's illegal to edit gameplay itself.
However, C&D is just something companies do to be nice. Nintendo also has the option to sue them for things they already did in the past. No matter how much they remove from the current game, they are still responsible for uploading and sharing the Skyloft model to hundreds of thousands of people, not to mention music. This is something Nintendo can sue for millions for at any point in the future, and there is nothing they can do to defend against it, because they are already guilty and the damage is done.
PMDT assumed the worst that could happen would be that they removed what they did, what they didn't realize is that their past mistakes gives Nintendo rights to demand millions of them at any point in the future. That's why they just want to be forgotten, and hopefully Nintendo will forget about them too. Nintendo really got them now, they can ruin their lives at any moment, and they are really scared of that happening.

Once you download that, use winimage to open up this SD card raw file, go into PM, PF, fighters. Delete snake's folder and go into sami's folder and rename everything containing her name to snake and do not change anything else.

Isaac is but a dream at this point. I've tried the dev build and i can't understand how people think he's anywhere close to 50% complete. Most of his animations are jank, moves are taken from other characters (ike, ganon etc.). Sounds, textures for his specials and effects are all completely missing.
