It's a way for companies to get capital. they generate capital buy selling products that they intend to make and taking that money to create the products and services that are promised. It is a breach of contract and it aggravates the matter for them to outright say "we're under no obligation to do anything". Kickstarter makers need to stop this "back us for $50, and you'll receive the full game and a t-shirt!" stuff, because that means it wasn't just a simple donation, there were conditions under which money has changed hands, and if those conditions are broken then there is possibility for legal reprisal.
