Because Eric Garner's death was caused by the negligence (if not malice) of the officer that had him down in an illegal hold. To make a reference to that death but have the officer in question be intentionally made into the most sympathetic guard on the show and then kill her in a scene in which it's clearly an accident since he was overwhelmed and just trying to follow orders trivializes the whole thing.
That scene was meant to be about what happens when corporations overpopulate prisons and throw cruel and inexperienced guards into the mix but they decided to try to make it about BLM at the same time for a more emotional punch and it just came across as an exploitation of black tears and white guilt.

After rewatching the last five minutes of Season 4, it occurs to me that IF Daya does shoot Humps, the female CO will probably get torn apart by the other inmates.
Also, why the FUCK are there so many male guards at a minimum security female prison? That seems the type of thing that could obviously lead to power abuses and sexual harassment and abuse. Wouldn't it make more sense to only have female guards in a female prison and male guards in a male prison?

Yeah, the sympathetic portrayal of Baxter was the only thing I could think of that seemed a little inappropriate. It's an interesting angle but they shouldn't have made her death such a blatant reference to Eric Garner's if they were going to use it.
Posing the whole riot and BLM stuff as a "misunderstanding" is controversial, but I don't think it was supposed to be a generalized social commentary. I'm certainly glad they took that direction rather than just preaching about social justice. Don't misunderstand, I'm not /pol/, but to use the show as a tool to teach us about injustices like that would underestimate the viewer. We KNOW that Eric Garner's death was tragically bullshit, we know that black people are targeted and wrongfully murdered. Instead of making the finale a PSA, they created a unique gray-area dilemma, an outlier to the situations that BLM was born from. OINTB knows who its audience is, instead of pandering to them they challenged them by making all sides of the situation (aside from MCC) empathetic, and I applaud that. Their intentions can easily be seen as disrespectful though when compared to a real life situation in which right and wrong is more easily determined, such as Eric Garner's murder, and making the catalyst to the riot a reference to that event makes it hard not to compare the two and see it as a commentary.
I don't think Poussey's death trivialized anything, if anything the accidental nature of it makes it more tragic. A point that they tried to make throughout the season is that the prison system negatively affects everyone involved, not just inmates.
