Unlikely since nobody will see your film and you probably won't profit off it. I don't know how much his estate cares or how profitable Orbison is in 2016 but I wouldn't want that kind of problem

It's a risk. I don't know who owns the rights to Orbison's work but the estate seems to be fairly active. There was a nice box set of his recordings a few years ago.

If it's submitted to festivals you need rights. If it's just for making it you don't need any permission. I think you can use 10 seconds of a song for free?

Damn really okay well I guess that scraps that. Is it really cliche to use it? I didnt know that, this one actor I had was messing around in rehearsal and he did such a good job hitting those notes I thought it might be cool to use that. Oh well, if it's cliche than maybe not using it is for the best
