Spanish here. I don't know the laws in other country, but in Spain it works as follows: if you don't have criminal records, you won't go to jail if you get a sentence of less than 2 years. So when there are cases like this (that is, somebody with no criminal records like Messi) the lawyers in general will be able to achieve a sentence below 24 months (kek at those cheeky 21 months).

In any case it's quite common. For regular people with everyday "normal" crimes it happens, usually judges are not assholes.

So yes, even if he is Messi and he is filthy rich, it's a common thing to go under 24 months for the first sentence.

It's pretty much the same (we copy everything from Austria/Germany). Judges never want to sentence someone to prison (unless it's something horrible like murder, child abuse etc) so people with a clean record are protected in some ways. It's the same with some pub owner, if he doesn't pay his taxes his pub gets closed until he does (and maybe some extra on what he owed). Richer people shouldn't be punished more and 1-2 years of conditional prison is fair. After all most regular people pay their taxes even though they struggle in life so it's disgusting when rich people who can, don't do it.

In most European countries it only works for sentences up to 2 years. So if you punch someone in the face and give him a small bruise you won't end up in prison (unless it's not your first time and it wasn't in self-defense etc). If you rape someone and you previously fought in war, got 16 medals of honor, got a Nobel prize for piece, found a cure for cancer... you will still end in prison.
