Freedom is a default state and therefore a natural right. If the government wants to take away your rights, it needs to prove that you have done wrong, because otherwise the government itself would be the crime of depriving you of your natural rights, just like some thug who kidnaps and rapes some slut.
So in short, the burdon of proof lies with the government, because they need a standard, which sets them apart from normal criminals and which gives their judgement legitimacy.
