Only the battle scheme would be of issue. Dragon Quest monsters gets away with it just fine. As long as it doesn't have the same look and feel he should be fine. There have been a few things like some hard core bestiality porn and a freeware game that let you fuse pokemon, that nintendo cracked down on but those are pretty niche cases.
