Actually it's not (at least not here in the US). As long as you're in a public space (sidewalk, streets, park, beach, etc) you don't need people's consent to take their pictures. Even of children. Even if it's the inside of someone's private property, as long as the camera was on public space when the photo was taken, it's legal. Mostly because it's a freedom of speech and freedom of expression thing. With the exception of a few states, even taking provocative pictures of people without their consent is legal.
However, if it's on private property (house, building, restaurant, etc), that's a different story. You need permission of whoever owns the property to take photos in it, even of public spaces outside, as long as the camera was on their property, you need their permission first. But that's kind of the thing here, you need the consent of the property owner, not necessarily the subject.
