"Legacy CAPTCHA" is 4chan's moniker for Google reCAPTCHA v1, which will likely be decommissioned in the future due to it being old. Even then, you can only change it for the Quick Reply box.
Current CAPTCHA is Google reCAPTCHA v2.

I guess they forgot to correct the setting's description. Nonetheless, relying on v1 isn't a good thing since Google will most definitely remove it in the future so it's best that we deal with the issues in v2 right now. Delaying the inevitable might make the problem worse.
