The Constitution overrides any law that many contradict it. Minnesota struck down a law that prevents people from "encouraging" or "advising" suicide on First Amendment grounds a couple years ago.
She's being indicted on "involuntary manslaughter" charges because they can't get on her on speech. I don't think they'll be able to make it stick.
