It was a bit more complicated, the Ottomans did not annex the southern parts immediatley after Mohács, and they only captured Buda after 1541. Until that period there were some serious infightings (a proud Hungarian tradition) between the supporters of Ferdinand von Habsburg and John Zápolya as both had claims to the throne. John Zápolya actually offered to become a vassal to the Sultan to gain the throne. But at the end this lead to the splitting of the country to the Habsburg part (who had legit claim), the Ottoman part and to the Principality of Transylvania which was an Ottoman vassal state.

Habsburgs indeed transformed what was left of Hungarian kingdom, into a province.Royal Hungary was the symbol of the continuity of formal law[5] after the Ottoman occupation, because it could preserve its legal traditions.[6] however in general it was DE FACTO a Habsburg province.[7]
