No it's the first distorted one at 3:15 is kirk. It's easy to tell, his sound is distinctive, especially his weak vibrato.
The second one at 5:53 is James, it's much more distinctive of his style and doesn't really sound like kirk. The phrasing at the end is very uniquely james

3. James Hetfield
With the departure of 1 and 2 the music quality was already declining. Ride the Lightning and Master of Puppets are their highlight albums that feature material from these 3 members. In Justice they used all that remained of Burton's bass material, which is probably the only reason it's an OK album. The "black album" is completely commercial but at least producer Bob Rock pushed them to write decent riffs and solos. He is most likely responsible for Kirk Hammett's for The Unforgiven and Wherever I May Roam solos, which are arguably the best of his career. Everything since then should have been under a different band name.
