The decided it was "extreme carelessness" rather than a deliberate attempt to do harm to America. In this case, intention seems to matter. The trouble is that no crime was properly committed in the sense that no top secret information was handed to anyone else or made accessible to anyone else. Since this is only a hypothetical crime, the only matter really left to asses is the intention of the main person involved. Since there was no problem there, we're left with a complete non-crime, so no prosecution. If there was even a small chance of conviction, they would've gone through with it because the stakes are so high. And if there was really something to this, Bernie would have made it work last year.
