Stannis is the rightful king. He knows the throne is his birthright. More importantly it is the right and lawful thing that he be king. There is no question about it, he is the King of Westoros. As king he has duties such as protecting the realm and punishing the unlawful.
That means that Renly has to die. He was a rebel and a traitor. He deserved to die. The Stannis that had to be done, after Renly refused to join with him. So Stannis would have killed Renly either way. Assassination wouldn't be his first choice but Renly would die.
