There's a difference between expressing your opinion and plain insulting someone, the former is protected by GG Art. 5, the latter is not. If you read at Böhmermann's poem, it's very, very hard to argue that it's still an "opinion" since he basically just listed one insult after the other. It wasn't critical or insightful, it was just edgy for the sake of being edgy.
