Political parties can choose to allow anyone affiliated or not to vote in their primary. The Democratic and Republican parties in some states choose to prevent people from doing so. Your hypothetical "Independent Party" can allow registered Republicans to vote in their primary if they wish. However parties generally block people outside the party to prevent sabotage.

The political parties don't run under any real law. They form their own Constitution. You have to be part of the party in order to vote for their policies or leaders.
