Well he was well aware of the consequences and its unlawful to insult the Head of State (also this is some serious insult here). So he had it coming, and i think he wanted it that way.
I admit, that there might be some truth in what Böhmermann said, but if i imagine, that this would be a poem about my father or mother I surely would want to see him charged.

It`s an old law way back from the time of MEIN KAISER, and was intendet to protect foreign monarchs. In 1953 it was adapted into the criminal code of germany.
It is very rarely used, and many are calling for it to be abolished due to the current situation.

Even if it is rarely used (a few weeks ago a Pegida/AFD? protester was arrested and charged because he insulted the german president Gauck) it is still part of the StGB and hence a violation can be charged.
I think this law wont be abolished in the next time. It might protect dictators and such but it also protects the "good" leaders of democracy, like its protects their authority, which i find isn´t a bad thing.
