Very old rules steeped in tradition, similar to how the distance over the table between the red tape the pm and leader of the opposition have to stand behind in parliament is longer than a sword so they couldn't kill each other in days of old. He's covered under parliamentary privilege regarding slander but he knew what he was doing because he's done it repeatedly before and Bercow pulled him up on it. Bercow gave him time to apologize (After BTFO-ing a junior minister) but he wouldn't because he knew it would be headlines and they can't strike it off the record.
