That's the point, actually. The information's been sitting out for years. Either they have access to all of it already, or 3rd parties don't care. We aren't the UK yet in terms of data encryption.
The servers, according to /g/, were all registered under the guy's name and were fairly easy to trace back to find where they are. The question /g/ had was why would someone make the location THAT obvious.
The thing is, there's a gagging order on him. If the story gets out, he gets arrested. So, the dead man switch comes in. They arrest him, the story gets out anyway due to the lack of a password. It's lose-lose, unless some smartass from here manages to get in first.
Then, hypothetically, he can play stupid and say, "Oh well, it got hacked, not my fault! What a shame it was easy to find!"
Legally it becomes a mess, but it's easier than forcing the guy to shoot himself or run away.
