Battery is battery. Some sort of contact was made. But not nearly within the amount of force as was described by the reporter. Now the reporter was, at the most shoved aside. Not thrown backwards. In the video you can see the reporter reach for Trump. Ignoring the perimeter of the secret service guards. The reporter is rightfully dispatched for Trump's safety. Now here comes the reasoning part.
You can say sue someone and win for battery if you have a justifiable cause such as minding your own business and being suddenly shoved aside. Whereas in this case the reporter was seen as a nuisance to Mr.Trump and his security team and additionally did not want to be engaged for an interview by Trump. She attempted to physically notify him by reaching out and she was dispatched in order to keep Mr.Trump moving and to assure his safety. Therefore the reporter was not minding her own business and was assertively attempting to attract Mr.Trump's attention.
