If I create demand for this product that existed before smartphones that product should stay on the market if I'm willing to pay for it.

I would bet my life that the majority of people who use disposable phones do so legally and do not intend to break the law. Not everyone wants to be tied down in a contract or hand out personal information for everything.

Disposable phones can in fact be traced so you're wrong. The Sim cards must be bought either physically in a store or online via a credit card. Manufacturers keep detailed records as to where these cards are shipped and to what stores. These same stores all have cameras. So you see, there is clearly a paper trail left behind for an investigation if an investigation is necessary. I'm not even mentioning cellphone towers being pinged to give away Geo location of the burner phones because these phones operate on major carrier networks that will easily comply with judges request.

Burner phones are not safe havens for criminals. Voip phones online with an obfuscated IP address would be more of a threat. Or even any instant messaging app on your device would work seeing as logs are not kept although I would guess metadata per account is stored.

As someone who is often in foreign countries for work (see my flag), I agree it will be impossible to enforce.

You will always be able to walk into any cell phone shop in China and walk out with a phone and SIM card, capable of international roaming, for cash and No ID.

The only issue will be when you run out of credits (or load) on the pre paid SIM card, how you will "top it off" while you are in the States or wherever.
