Basically neither the shirtless man or the two men harassing him would be considered an "innocent". Neither side was a danger to anyone outside of the parties involved, therefore there was no legal justification for a 3rd party civilian to interject himself into that situation. Navy Seal dude is therefore just a man who came up behind someone else and attacked them with no legal justification. Shirtless man could sue him.
But no criminal charges, because legally, all three parties in that are equally at fault so any arrest would have to be performed on all of them and it's just not worth the time or effort for most police to do that. Let alone cost for any charges filed. Most peace officers would simply break up the group and see them all on their separate ways.
