What the homeowner did may or may not have been illegal depending on local statutes.
Usually you have to be in your own home and "forced into a corner" before you can kill someone legally. They don't have to have a weapon but they have to at least be threatening bodily harm.
Shooting a fleeing suspect is a real grey area. In this case the shooter can say she thought he might have been a threat since he was coming out of her house and she didn't know the intent, but it looks pretty bad. If the District Attorney in her area is a dick he could prosecute her.
