www.nytimes.com/2016/03/17/world/asia/north-korea-otto-warmbier-sentenced.html

>An American college student who tearfully apologized for trying to steal a political propaganda poster from his hotel in Pyongyang, the North Korean capital, was sentenced on Wednesday to 15 years of prison and hard labor.

>But even by North Korea’s standards, the punishment for Mr. Warmbier appeared to be extreme for an act that might amount to a harmless misdemeanor elsewhere. The Obama administration, along with Mr. Warmbier’s other American supporters and rights activists, denounced the sentence.

>Gov. John Kasich of Ohio, a Republican candidate for president, said in a statement on his website that Mr. Warmbier’s detention “was completely unjustified and the sentence North Korea imposed on him is an affront to concepts of justice.”

>Over the years, North Korea has used detained Americans to try to gain diplomatic leverage against Washington. Some detainees were released only after prominent Americans, like the former presidents Jimmy Carter and Bill Clinton, visited Pyongyang.

>The Obama administration, along with Mr. Warmbier’s other American supporters and rights activists, denounced the sentence.

So, what are they going to do to get him out?
>>
>>67678055
Murricans have been imprisoned before over there. They only way they get out early is if U.S. officials go over there and personally pay their bail. Last person to go over there was Bill Clinton I think, to free some journalists.

>In a tearful statement made before his trial, Warmbier told a gathering of reporters in Pyongyang he was offered a used car worth $10,000 if he could get a propaganda banner and was also told that if he was detained and didn't return, $200,000 would be paid to his mother in the form of a charitable donation.

>Warmbier said he accepted the offer because his family was "suffering from very severe financial difficulties."

>Warmbier also said he had been encouraged by the university's "Z Society," which he said he was trying to join. The magazine of the university's alumni association describes the Z Society as a "semi-secret ring society" founded in 1892 that conducts philanthropy, puts on honorary dinners and grants academic awards.

This is fucking retarded.

Why was he in north Korea in the first place? He could of gotten a god damn job and bought a 10k car while he was busy fucking around whatever hoops you need to jump through to even get to north Korea.

This was all over 10k? The 200k is irrelevant because I'm sure he didn't plan on getting arrrested over there.

He literally could of sucked cock for a 10k car in 2 weeks.

I feel bad that he's so fucked now but man its hard to sympathize with these people who go out of their way to visit these garbage parts of the world, the fuck is wrong with you? Its like those bitches that go to Africa and predictably get violently raped and sometimes murdered by dindus.

dont visit north korea unless youre a chink or singaporean chink

"Relationships between the two countries are warm and friendly if not active at the official level. However, there is some trade and investment in DPRK from Singapore, especially with consumer goods.
DPRK citizens can enter Singapore visa-free.[2] Singaporeans holding a normal passport can also obtain this visa waiver for both business and tourism after obtaining authorization from the North Korean government, allowing themselves to visit North Korea for a period of up to 30 days without a visa. [3] North Koreans occasionally travel to Singapore for medical treatment."

well.. um argentina-"don't call me white"-anon lenin, mao, stalin, all of them were capitalists who ran the guise of a socialist state..

what do you think communism is? it's nothing more than an idea, just like capitalism. the problem with communism, historically speaking, is that you have to kill/remove capitalists and other "free thinkers" and you have to maintain the state through violence. but then you have to be able to export/import with other states so that you don't inevitably starve like NK

how does communism truly work? see: NWO, catholic church/jesuit army, jewwminati

Of course they're not going to get him out.

He broke a foreign nation's laws, and while it's legal to disagree with the laws, the US has no right to defy them.

The most the US can do is use backroom channels and quiet diplomacy to get him sprung. But I don't think it will work because this is North Korea and they really don't like America, of course, and money is no real incentive for them to give up a point of pride: a young, white American citizen. They're going to regard him as a trophy, a symbol of NK's power over the US. They won't let him go.

More to the point though is that it is the traveler's responsibility to be familiar with a foreign nation's laws before visiting it, and to abide by those laws as the US has no jurisdiction there. That sounds obvious, but reading these threads, it seems that a LOT of Americans think that they can act any way they want in foreign lands and that the US government will bail them out as required. That's just not the case.

The state department does not exist to bail out morons who volunteer to unnecessarily go to the most dangerous dictatorships on Earth only to fuck around with the laws. If anything, as the Sec of State, I'd be so embarrassed by the stupidity of that kid that, if anything, I'd revoke his citizenship and pretend he never existed.

Hoeryong concentration camp is a prison camp in North Korea...The camp is a maximum security area, completely isolated from the outside world.[1] Prisoners and their families are held in lifelong detention.

In the 1990s there were an estimated 50,000 prisoners in the camp.[14] Prisoners are mostly people who criticized the government,[15] people deemed politically unreliable (such as South Korean prisoners of war, Christians, returnees from Japan)[16] or purged senior party members.[17] Based on the guilt by association principle (Korean: 연좌제, yeonjwaje) they are often imprisoned together with the whole family including children and the elderly.[12] All prisoners are detained until they die; they are never released.[18]

Former guard An Myong-chol describes the conditions in the camp as harsh and life-threatening.[23] He recalls the shock he felt upon his first arrival at the camp, where he likened the prisoners to walking skeletons, dwarfs, and cripples in rags.[12][24] An estimates that about 30% of the prisoners have deformities, such as torn off ears, smashed eyes, crooked noses, and faces covered with cuts and scars resulting from beatings and other mistreatment. Around 2,000 prisoners, he says, have missing limbs, but even prisoners who need crutches to walk must still work.[25]

Pt 1/2
>>
>>67691492

Con't...

Prisoners get 6.3 oz of corn per meal (two times a day), with almost no vegetables and no meat.[26] The only meat in their diets is from rats, snakes or frogs that they catch.[12][27] Ahn estimates that 1,500–2,000 people die of malnutrition there every year, mostly children.[14]

Children get only very basic education.[29] From six years on they get work assigned...many children die before the age of ten years.[30] Elderly prisoners have the same work requirements as other adults.[31] Seriously ill prisoners are quarantined, abandoned, and left to die.[32]

Prisoners have to do hard physical labour in agriculture, mining and factories from 5:00 am to 8:00 pm (7:00 pm in winter),[13] followed by ideological re-education and self-criticism sessions.[36]

The mines are not equipped with safety measures and, according to Ahn, prisoners were killed almost every day. They have to use primitive tools, such as shovels and picks, and are forced to work to exhaustion.[19] Kwon Hyuk reported that corpses are simply loaded into cargo coaches ...to be burnt in a melting furnace.[18]

You're retarded. The grown ups are in control. They will not send seal team 6. Chuck Norris will not save the day. The state department repeatedly tells all travelers to obey the laws of foreign nations and that they are responsible for their own legal concerns. They are also often advised not to travel to countries on "black lists". NK is on that list. The state department has covered its ass fully in this matter. It has no obligation to help the retards who disregard state department warnings and who break foreign laws.

Why do Americans think that life is like an action movie? I guess that's what happens when you never travel. The world is what Hollywood tells you it is.

From the US State Department:

>The Department of State strongly recommends against all travel by U.S. citizens to North Korea (Democratic People's Republic of Korea, or DPRK). This replaces the Travel Warning for North Korea of April 15, 2015, to reiterate and highlight the risk of arrest and long-term detention due to the DPRK’s INCONSISTENT [my emphasis] application of its criminal laws.

Because I, and the people I know, don't go trespassing or stealing things - we tend to follow the law.

I'm not scared of it at all, they're not scared of it at all. It's not that hard to not get arrested.

And no, there are ski resorts in lots of places. As cheap and unpopulated as this? Maybe not, but people like to travel.

Nah, I'm not a shill, I'm just a US law-working citizen who studies NK a lot, so I offer info here since a lot of people for whatever reason don't have, or don't look for, source material. I don't think it's terrifying. I don't think it's good. I think socialism is shit, I think their laws still have improvements to be made. But I think they're taking steps in the right direction. They amended their criminal code to a vast degree in 2004 and building up to that, even eliminating their retroactivity principle. They added in the 2000's laws about foreign investment and opened up increased tourism for people, including US citizens. Their education system has slowly been getting revamped with the expansion of their international university and building new apartments for students and teachers.

So I think it's fine to go. We obviously think of the country differently, and that's fine.

Oh, no, I'm of the mind that he committed a crime and is thus stuck within their legal system.
Amusingly he wasn't sentenced solely on theft, as that doesn't give you the 15 year sentence (I'll post the theft article below in case anyone is interested). I was just saying the state warning doesn't do much aside from BIG RED HEY NO NO.

Theft:

Article 296 (Stealing Personal Property)
A person who steals the property of an individual shall be punished by short-term labour for
less than two years. In cases where the person commits a grave offence, he or she shall be
punished by reform through labour for less than two years.
In cases where personal property is stolen in collusion or in large quantities, the punishment
shall be reform through labour for more than two years and less than seven years. In cases
where a particularly large amount of personal property is stolen, the punishment shall be
reform through labour for more than seven years and less than ten years.

I don't get it. Why wouldn't they want him to take the poster back with him? The poster would help spread the message that North Korea is a wonderful place to live.

I'm assuming that's what the propaganda poster was -- right? A poster that says how wonderful North Korea is? Why would they possibly object to him taking the poster to other countries to help spread the propaganda?

A better comparison might be something like someone stealing an American flag, a bible, etc. the "propaganda posters", as they are being called, tend to be quotes or statements directly from or of the 'great leaders', and thus have political significance. Stealing them, or trying to 'deprive' people of them, makes the crime political depending on intent and all.

And given the story he gave them (which sounds bullshit) that's what it turned into. yeehaw,.

>>67696441
Yes. 15 years is a long time.

So far NK releases their foreign prisoners within a year or so of sentencing, including the last US one who was sentenced to 15 years but remained there less than 1 year. That tends to be the pattern.

If you're interested in an interview with an american citizen who was sentenced to a hard labor camp similarly, here: https://www.nknews.org/2014/11/matthew-millers-excellent-adventure-in-north-korea/

I'd be curious to hear any particularly interesting excerpts, or even just ones relevant to this case. North Korea always struck me as somewhere that would be absolutely fascinating to visit, just because culturally they're so different to the western world. I don't have a lot of sympathy for people who go there, break their laws, then complain when they find themselves punished by a foreign justice system based on an entirely different culture.
>>
>>67696697

Honestly even 1 year of indentured hard labor is quite extreme for simply stealing a poster. And that's assuming that he will, in fact, only remain there "less than 1 year" when NK has a reputation for using foreign prisoners for political gain.

You can quote their criminal code if you'd like but that doesn't make it right. To be fair, though, my problem lies more with China protecting them and similarly the rest of the world community not glassing the fucking place to begin with.

But this is 4chan and I'm open minded, and you are enough of a shill to at least be able to quote source material, so what I'm more interested in is China.

Why does China protect NK? What do they have to gain from it? Could you explain that to me and cite it? That would actually be useful. NK is a failed state but what I'd really like to know about is why China protects it because afaik they're the reason we haven't glassed the place yet.

Yeah, sure, there are definitely some interesting things - especially if you are used to standard western values, since they have a very different understanding of what 'free speech' and all is.

Random example:

Article 193 (Import, Keeping and Distribution of Decadent Culture)
A person who, without authorization, imports, makes, distributes or illegally keeps music,
dance, drawings, photos, books, video recordings or electronic media that reflects decadent,
carnal or foul contents shall be punished by short-term labour for less than two years. In cases
where the person commits a grave offence, he or she shall be punished by reform through
labour for less than five years.

>>67697661
I agree. But just keep in mind it wasn't just a 'poster', it was a special state related document assigned for that building in a private employee's only type zone. That doesn't justify the year,of course, but I do think that people who keep just saying "poster" fail to understand the significance of that poster to the people who owned it. That significance may be silly, or even arguably dumb, but it is there.

See, China is something I hope other people can teach me about too. I've heard people say "geopolitics" and stuff, saying NK is a buffer state. But my knowledge of China-NK relations extends only historically as it relates to Korea (japanese-sino, etc), so legit I can't help on the China front. Maybe some cool dude who happens to be in the thread will enlighten us both.

All I can say about China is (and this is knowledge from NK stuff): they import coal from NK, they import cigarettes from NK, they important other "mineral" related stuff. I have no idea how significant those are, but as an example, here is coal at Rajin Port being readied to toss to China.

I know. I already said this, so I'll just quote what I said exactly and you can read it again:

>I mean, the kid is obviously a fucking asshole, but that doesn't really excuse NK for being a piece of shit dictatorship.

I agree that the kid shouldn't have been there in the first place, yet alone actually tried to break their fucked up law, but you can't say their law isn't completely fucked up in the first place. That's my point. "Baffled" is a pretty harsh term. I was making a comparison.

15 years.

Hard labor.

Again, that kid is an asshole for attempting this in the first place, I don't even agree people should even GO there in the first place, but on the other hand their laws are completely fucked up and inexcusable.

Here are some cut out articles I'll paste that are interesting and help understand their GENERAL criminal scheme. For the list of punishments, it is "most extreme" to "least extreme", so that should tell you what they value comparatively.

The pic attached is a graph that I made myself to keep track of their death sentence choices as they continue to amend their criminal law, I hope you find it useful!

Article 27 (Types of Punishments)
Punishments are:
1. Death
2. Life-time term of reform through labour
3. Limited term of reform through labour
4. Short-term labour
5. Deprivation of the right to vote
6. Confiscation of property
7. Removal of qualifications
8. Suspension of qualifications

Article 39 (Conditions for Determining Aggravated Penalties)

So easy even I can answer:
The korean peninsula is strategically important for both China and the US to control. US already has a foothold in SK and if NK's regime is overthrown and Korea unites while being allied to the US, China is afraid the west will setup missile bases right at its border in the future. Also China supports NK to flex its own political power in the global community. If it just lets the US "glass" the country it will look weak to everyone else who isn't a commie

No idea if this is of any significance either, since I imagine China has its own power stuff, but here is a pic of the NK power grid.

Red & orange - Fossil-fuel power station
Yellow - Nuclear power plant.

Maybe not as much as stealing from NK, he should have stolen from a country with not so strict laws.

Inexcusable by what standards? If you were born and raised in NK you'd think it was fully deserved.

Might as well complain about how lions hunt antelopes to eat, and be all 'yeah I know they need to do it to live and all but murder is fucked up y'know I mean this is a first world country famalam'. I don't even see what point you're trying to make beyond just being upset that the entire world isn't america.

Which, if anyone is curious, actually has to do with NK's emblem. It's a hydroelectric dam. Pic related.

Quoted from their Constitution:

Article 169. The national emblem of the Democratic People’s
Republic of Korea bears the design of a grand hydroelectric power
station under Mt. Paektu, the sacred mountain of the revolution, and the
beaming light of a five-pointed red star, with ears of rice forming an
oval frame, bound with a red ribbon bearing the inscription “The
Democratic People’s Republic of Korea.”

I posted a pic of Mt. Paektu earlier in the thread I think.
>>
>Again, that kid is an asshole for attempting this in the first place, I don't even agree people should even GO there in the first place, but on the other hand their laws are completely fucked up and inexcusable.

Of course.

But here are the options:

>Plan 1: do nothing besides ramping up defenses and alliance-building
>Result: communists slowly spend themselves into oblivion then nature runs its course

>Plan 2: fight them head-on with a volunteer army instead of the draft
>Result: nuclear terrorism, possible open nuclear warfare due to capitalist/communist alliance networks

>Plan 3: genocidal sanctions for the peasantry, quid pro quo for the inner party
>Result: exactly what we've seen from the Clinton administration to the present day

Lol you've just proved my point. The one reference you pull is from a Seth Rogen movie. Americans really only understand the world in terms of Hollywood.

As I said, the adults are in charge. How many Americans are currently imprisoned abroad? Tons. And some of them end up being executed, too. How does the US respond? With "great concern" and lots of hand wringing, but no action. Why? Because they're not hostages. They're criminals.

If US special forces had to be mobilized every single time an American was incarcerated for an unduly harsh time, they'd never get to NK because they'd be too busy trying to spring yanks from prisons on American soil. The truth is, yanks don't give a shit about anything except for that the media (read: state department's lapdogs) tell you to get excited about. The media will forget about this kid and so will America and then it's back to the gossip pages for you.

Special forces are sometimes used to rescue political hostages, but that's not the case here with this kid in NK. He's just a dumb tourist who thought, as you do, that he owned the world. USA USA USA. Pathetic.

Now go watch some more Seth Rogen for your insights on international affairs.

That doesn't really explain anything because it just makes me wonder why China doesn't glass the country itself (or otherwise invade and take over since they clearly have the power to do so if they wanted).

It's not that I don't understand that they don't want the U.S. to set up military shit at their border, everyone who's into world politics knows that at least. The question is why don't they just take that shit over themselves instead of letting Kim Jong Faggot rule the place and make nukes and threaten people, which I'd assume ultimately hurts the Chinese defense of the place? If NK actually blew some shit up, even just SK, there'd be serious hell to pay as a result, and China just doesn't seem to give a fuck.

I mean, to try to answer my own question, I'd assume "well they don't want to have go in a have the blood of a bunch of people on their hands, it's easier to just let kim do what he wants and ultimately just keep to himself than to overthrow his dictatorship violently", there's still gonna be blood on their hands if they actually pull some shit at some point.

News reports like this have been coming out recently too: http://news.yahoo.com/ap-analysis-n-korea-nuke-threat-not-bluff-092457146.html

Whether they can actually do anything or not idk, but the more time passes the higher that chance becomes. Is China just rolling the dice here? Hoping NK doesn't actually start some shit ever when they're obviously trying to?
>>
>>67695437
North Korea forced him to say that shit. Whenever Americans are arrested/charged on some silly bullshit in NK, the authorities force them to confess that they're working for the CIA, etc.

Thanks, that's pretty interesting to look at. Their laws don't seem as insanely draconian as a lot of the people in this thread - or even our media - really portray them as. There's a lot of focus on protection of the state, but that's hardly surprising given their culture. I wouldn't want to live there, but it looks like you'd really have to go out of your way to do something that would result in an arrest. So long as you're polite and respectful there shouldn't be a problem.

I have a dwindling suspicion he's pulling a lot of this to sound like a special snowflake sympathizing with the Orwellian dictatorship.

Of COURSE the tourist spots and unrestricted cities are all going to look lovely. That's what Stalin did to fool American journalists. Behind the curtains, they have fields of enslaved workers who get beaten/executed for amusement. Yeah, they'll release a few prisoners that western media reports on, but they'll shadow-kidnap and execute foolish westerners.

Yeah, there is a LOT of protection on the state - but part of that is because the state owns most things. They also have some laws that seem foreign that relate to job performance - like over/underreporting productivity.

Some more examples, and I'm sincerely glad you're enjoying since I don't find a lot of other people who like reading law stuff.

Article 137 (Spoilage and Loss of Property)
A person who causes a large quantity of the property of the state or of a social cooperative
organisation to be spoiled or lost by managing such property in an irresponsible manner shall
be punished by short-term labour for less than two years.
In cases where the foregoing act causes a particularly large quantity of the property of the
state or a social cooperative organisation to be spoiled or lost, the punishment shall be reform
through labour for less than four years.

Article 143 (Failure to Inspect and Repair Equipment)
A person whose failure to conduct organised enterprises in accordance with the regulations
for inspection and repair of equipment leads to equipment damage or production stoppages
shall be punished by short-term labour for less than two years.
In cases where the foregoing act damages particularly important equipment or stops
production for a considerable amount of time, the punishment shall be reform through labour
for less than two years.

Article 158 (Violation of Crop Policy Regulations)
A person who violates regulations for crop purchase, transportation, processing, receipt and
supply, resulting in serious consequences shall be punished by short-term labour for less than
two years. In cases where the person commits a grave offence, he or she shall be punished by
reform through labour for less than three years.

North korea is chinas backyard. Its the only thing they have left in terms of regional power and control. Just like how mexico is the backyard of the United States.
