You've got cause and effect reversed here, as is normal. Because a person like Carson represents an existential threat to the Democratic coalition, he must be made to appear as you say. We've operated under these parameters for 200 years.
It would require the supreme Court to rule.
Also he wouldn't be indicted, he would be sued. An indictment is if a crime is committed, and only the DOJ could do that.
He would be sued, probably by the DOJ as well, and then every court that ruled in his favor would have to be appealed up to the supreme Court, like in the 2000 elections.
It's not going to happen. They won't even hear it unless they think there's a pertinent need to clarify it, and quite frankly, this supreme Court would rather strengthen foreign born people's power than diminish it.

It "costs" a good deal more than that, in that his 'plan' by natural law devalues higher education. A thing (an object, a skill, a catskin) obtains value through its rarity. If everyone is subsided to obtain a college degree, there will simply become a new barrier to meaningful employment. In the end, nobody benfits from the billions of redistributed public monies but the institutions themselves (all, incidentally, bastions of progressivism - funny who Democratic solutions often entails public funding of that which is more prone to support them)--which can charge as much as they like since the government is flipping the bill--and the public figure who gets to dole out the funds.
