Tuscaloosa, Alabama, USA - Three Tuscaloosa, Ala., police officers were suspended Monday after the video of their arrest of three college students “deeply disturbed” the city’s police chief.

The officer who showed up first at the 3:19 a.m. noise complaint Sunday, another who used a stun gun and a third who hit someone with a baton were placed on paid leave a day after their arrest of the University of Alabama students, Police Chief Steve Anderson announced.

>“You’re under arrest for harassment for grabbing my arm,” the officer bellowed. “I’m going to ask you one more time to get outside. Get outside now.” The man’s friends challenged the officer’s demands by asking if he was “being arrested or detained” and if so, the charges.

Jesus.

It is illegal to assault your fellow humans, normal logical people understand simple things like this.

If the music is too loud then tough shit, maybe you should move away and if it breaks the law the police should write the ticket, if they refuse to let the police in you can cut the power at the point and turn off the water, they can show up to court and pay the fines if they want it turned back on.

Look at that a non violent solution! I'm amazed we didn't even have to kill one person.
>>
>>55443161
Why even try to grammar if you can't?
>>
>>55443161

Where I used to live there was a noise ordnance at 22:00. You were not supposed to be loud after that, but before that you could be as loud as you wanted, pretty much. If neighbors didn't like it then tough shit, they couldn't do anything about it until after 22:00.

>>
>>55443486

The people can shut off the power and electricity not the police, if you don't want to be part of the community and its rules you can be separated from it. That doesn't require force but I guess your preference is your fellow humans eating through straws and diplomacy at the barrel of a gun?

I think trading decency for electricity and power because you won't address a police officer better than getting your shit stomped in because officer hard on is having a bad afternoon.
>>
Police legally cannot step foot on your property unless invited or reasonable suspicion of a law being broken.

Loud music isn't a law being broken, and can be ordered lowered. If the offending party refuses to comply, then the officers have grounds to enter the property.

What happened here are the police broke the lay, busted a few heads, and now your tax dollars are going to pay for a settlement to these kids.

Let's be realistic, cleaning up after stupid police mistakes has gotten far too expensive. We should just automate the police officer.

>>
>>55444805

They aren't going to break the door open over a noise complaint, they'll make a report they weren't allowed in and the next day a civilian employee from the court will come to attempt to serve an ordinance violation and you'll just refuse and they'll make a report of that and just leave. If you break the noise ordinance a lot they'll eventually serve you a warrant for an actual law being broken and serve a summons to your home.

Notice how none of that process involves violence?

That is because violence is illegal. The police entered the home without a warrant and they assaulted the occupants of that home with deadly force.

Entering without a warrant.

Using force for enforcement of an ordinance (ordinances are not the same as laws, they are enforced by the municipality only and only are fines. You can't use force to illict an ordinance and the police cannot legally enter the residence to enforce them. Technically speaking if they left the music on all night and never answered the door the police would eventually be forced to leave to handle real police work.)

Unauthorized use of deadly force.

http://www.worldlawdirect.com/article/1708/when-can-i-arrested-police.html
1. You may be arrested by a police officer who personally saw you violate any statute, city ordinance, or federal law. The law may be a serious crime (a felony) or a lesser offense (a misdemeanor). The important thing is that the officer sees the violation.
>>
>>55451816
Maybe in Canada but in America if a police officer enters your house without a warrant, or without cause that somebodies life is in danger you can shoot to kill for breaking and entering. If you open the door and show them "look at all my law breaking" then they can say they are "in pursuit" and enter to arrest you. Otherwise, they cant do shit. Also, since noise cannot be seen, the officer must ascertain the source of the noise before making any claims.

If they show up at your door, and they can hear you committing a midemeanor
They CAN kick the door down, and arrest you for it.

That might not be normal police procedure, or what they will do in every situation. But they CAN do it, if they choose to.

If people are trying to sleep, they will shut you up, one way or another.

Here, have an excerpt from a cop talking about how if you dont OPEN the door, they cant do shit without a warrant except to go onto the property and knock on the door.

"In the case of a simple noise complaint (stereo too loud, barking dog, etc.) at a single family residence, standard procedure at my department was to always knock at the front door first, and try to make contact with someone responsible for the property (a tenant as opposed to a guest). Were I to fail to make contact this way, I would usually have dispatch look up a phone number for the address and call it, directing the person who picked up to answer the door.

There would only be a couple of instances where entering a fenced yard featuring a closed (but unsecured) gate might have come into play in my experience. The first might be if the house is a duplex or retrofit apartment building, and the principal entry door for the residence in question is only accessible via the gate in question. In that case, I would have the same right to attempt contact at such entry door as a delivery driver or a solicitor. The second would be if "exigent circumstances" developed while I was on scene that compelled me to enter the backyard - sounds of a fight, someone crying out in pain coupled with the sound of someone fleeing on foot, and so on. Exigent circumstances serve as a Fourth Amendment exception when I'm seeking to aid the injured or preserve evidence.

Even denied all of the above, I might (theoretically - this scenario never presented itself while I was a police officer) have the benefit of some legal precedent in entering an unsecured backyard:

An arrest occurs when the police take a person into custody against their will for the purposes of interrogation or criminal prosecution. In order for an arrest to be lawful, it must adhere to the probable cause requirement. Probable cause is sufficient knowledge substantiated by trustworthy facts to support the theory that the suspect has committed or is committing a crime.

Generally, law enforcement officials do not need a warrant to arrest someone. For example, arrests that occur in public locations do not require a warrant. However, there are exceptions to this rule. Generally, law enforcement officials in a non-emergency situation must have a proper warrant to effectively arrest a person in their home.

In the video the cop was ordering the occupant out of the house so he could be placed under arrest. The occupant attempted to close the door. The police are now justified in entering the house because they are making an arrest. A house is not a fortress that prevents all entry without a warrant.

If you have to talk to police and do not want them to come inside, then you go outside and shut the door behind you. Then when your dumb ass is arrested they will need a warrant to enter the house.

Why are there already a dozen officers out there for a noise complaint? Something happened where the officers on scene felt the need to call for backup. They don't send a dozen officers for a noise complaint. We are not being shown the whole story, therefore we cannot begin to place judgements on the situation. Police bullshit is a real problem in this country but I hate these only-part-of-the-story cop vids that people post. You usually end up finding out later that the people filming were obviously in the wrong but didn't bother to post the part that demonstrates that. I'm betting in this particular case the police simply asked for them to be quiet because of the noise complaint and the fucktards did something unnecessary to escalate the situation to the point that the officer was going to arrest them. Then they turn on the cam and claim police brutality.

If you've done nothing wrong you don't have to leave your place of residence and they can't forcibly remove you without warrant. The cop waits till he sees backup, then acts as if he's being pulled inside to cause a reaction from other officers. He's agitated the entire time because they know their rights and he can't do as he wishes. Pulls out his baton because a kid says they don't have to leave apt. Yea I'm sure that'll make anyone wanna go outside with him.

It doesn't matter who was right or wrong police should hold themselves to a higher standard. That situation could have been resolved without any violence if the officer was more intelligent and better at his job rather than immediately going for brutish violence.

Yes, those dumb college kids made his job harder, but that's the job he signed up for. He signed up to have a difficult job interacting with idiots and difficult people. He should be the one upholding standards and trying to resolve situations nonviolently. That burden should be on him, as he voluntarily signed up to put himself in those situation.

He failed at his duty of keeping the peace and resolving problems with civilians non-violently.

Perhaps it's because I live in Texas and from a legal standpoint, the home that I live in is basically sovereign property (not literally, but from a legal perspective that's not an absurd exaggeration), this would have been my reaction. Given that this is clearly an apartment, that may have not been an actual option.

Kids should have shut up and just let the cops be "right"; with that video footage, even before the police escalate it to violence, that officer would not only likely lose his job, but also be subject to civil/legal repercussions. Beyond that, you can also find a myriad of means to publicly harass a civil servant and legally get away with it.
>>
>>55444429
The fucked up thing here is that the cops were in the right, then because of their behavior the situation got way out of control and they continued to over react after the situation was back in their control.

People this easily manipulated into emotional reactions definitely should not be cops. I hope all three of those officers ride desk duty for the rest of their careers

They're just trying to bury the story (which is fine with me), "suspend" the officers so people think they were punished then people will forget about in a week.

The initial police officer who yanked the guy out was a little out of line but at the same time if an officer demands you get outside you can either comply or be forced to comply, starfishing against your doorway and screaming "am I being arrested?!" isn't a legal option.

TO SPEAK WITH OCCUPANTS: Officers had a duty to attempt to speak with the
occupants.49

For example, in People v. Camacho,50 discussed earlier, officers received a complaint
of a “loud party disturbance” at Camacho’s home at about 11 P.M. When they arrived,
however, they heard no loud noise and found no sign of a party. Nevertheless, they
walked into the side yard where they happened to see Camacho in a bedroom bagging
cocaine. The court ruled the officers’ technical trespass was not justified because there
was no disturbance and, therefore, no need to take any action. Said the court:
Indeed, had the officers on their arrival at defendant’s house heard a raucous
party, confirming the anonymous complaint that brought them there in the first
place, and had they then banged on the front door to no avail, their entry into the
side yard in an attempt to seek the source of the noise would likely have been
justified. [But here] the officers arrived at defendant’s home late in the evening
and heard no such noise. Without bothering to knock on defendant’s front door,
they proceeded directly into his darkened side yard.
Another example—this one demonstrating sufficient

POLICE CANNOT ENTER YOUR HOME UNLESS YOU INVITE THEM OR THEY HAVE PROBABLE CAUSE.

AN ORDINANCE VIOLATION IS NOT A LAW IT IS A MUNICIPAL ORDINANCE WITH GOVERNANCE OF FINES AND LEVIES IN A CIVIL MATTER SUCH AS LOUD SOUNDS, PROPER LINES, PARKING ENFORCEMENT, ETC.

THE POLICE CANNOT LEGALLY ENTER YOUR HOME IF YOU DO NOT LET THEM IN OR THEY DO NOT HAVE A WARRANT.
>>

>>

>>55457080

Loud MUSIC is not probable cause, IT IS AN ORDINANCE NOT A FELONY NOT A MISDEMEANOR.

First of all, top fucking lel with this retarded hyperbole.

Secondly, blaring shitty music and keeping people awake at night is how you get murdered. >>
>>55457173
You are so fucking stupid, you really should quit trying to be a lawyer because you're going to be in the shit if you manage to pass and have to defend anyone. The case you presented clearly states that if the officers had knocked on the front door (which in the college student's case, they did) any subsequently experienced violation WOULD LIKELY HAVE BEEN JUSTIFIED. ONCE THOSE CUNTS OPENED THEIR DOOR AND STOOD THERE LIKE RETARDS THEY OPENED THEMSELVES UP TO A PLETHORA OF CHARGES, ANY OF WHICH CAN BE USED TO JUSTIFY AN ARREST. I'm not saying it should be that way, even though I believe it should because I hate little inconsiderate shits and think the law should be able to fuck them up every way possible, but THE REALITY IS THAT IT BE WHAT IT DO, BITCH.
