Its usually based on the individual case at hand and the courts/jury would basically decide whether or not the individual in question could give consent and also whether or not the the defendant was taking advantage of the potential victims limited mental ability. In the US, if you have downs it's an automatic ticket for social security, all medical treatments are paid for my medicare. Downs is not only medical, but greatly increases the chances of other medical problems. My sister who was born with downs also had 3 holes in her heart, lung issues and a terrible immune system, it cost medicare, you average tax payer, $250,000 just to fix the heart and lung problems, no telling how many more issues she'll have over the next 40 years of her life. All of that is draining society, and she will never be able to work and repay those taxes. What right do they have to bring more potatoes into the world, that will drain more tax dollars, never contribute, and then someday themselves being allowed to pass on their affliction. If it wasn't for the bucket winch of medical advancements from the last 50 years dreging these potatoes out of the depths of the gene pool, most of these downs wouldn't have lived naturally past 3 months.

A freind of mine has a sister who is a top lecturer at a well known red-brick UK University.

There's a high chance. People with Down's have an extra chromosome (number 2, I think). Around half are infertile. The other half, if they were to have children, have a high chance of their child having Down's or other retardations. Though it is possible for a non-disabled child to be born, just very, very rare.
