/o/ I got pulled over and charged tonight with reckless driving and following too closely. I'm 18 and this is my first ticket. I'm wondering what's most likely going to happen at court? Is there any way possible to defend against these charges? I was driving on the interstate in a hurry but no way was I close enough to slam into the back of a car or anything like the officer said in the pic.
>>
>>14793413
Left lane is for passing m8, making passes on the right is rektless, though it seems like the officer was having a bad night more than anything. Be more aware of cops next time and you should be fine.
>>
>>14793413
>criminal traffic
>arrested
time to beg mommy and daddy for lawyer money
>>
Just tell the judge you are 18, there is no way you could have actually done something wrong, it's not your fault, works every time just like with your parents
>>
>>14793424
>rektless
Also if you're passing people on the right then whoever is getting passed is in the wrong for not passing while driving in the passing lane.
>>
>>14793413
Did you talk to the cop? Did you get arrested? Did you admit to reckless driving, or anything close to it?
How long were you in jail, or is the "post arrest" a mistake on the paperwork?
>>
Lawyer up. I paid $6k for a traffic reconstruction expert and a mediocre lawyer to beat my case. This will follow you and your insurance will cost you much more than you'll pay for a good lawyer.

You get what you pay for in lawyers, I wouldn't hire a lawyer for less than $5k. You have no choice but to fight this really hard. Good luck.
>>
>>14793450
I may have typed "passing" too many times
>>
>>14793413
do you drive a lifted truck?

did you say "AW FUCK GET OVER ALREADY" before passing on the inside?
>>
>>14793474
Mustang gt driver here, i say that all the time. what the fuck get out of the fast lane if you want to got 5+ the speed limit get out.
>>
You fucking blew by a cop and then passed in the right lane in front of him?

Jesus you're a fucking retard.
>>
>>14793458
you dont go to jail when you are arrested for minor shit in the US. They give you a summons to appear in court (OPs "ticket" is not a ticket lol) and release you.
>>
>>14793413
Time to lawyer up, it's your only option if you don't want to get rekt, as a reckless driving charge will tear your insurance rates all to hell until you turn 25.

Get a lawyer to plead it out to speeding, and you'll likely have to go to some sort of traffic school/defensive driving class
>>
Being 18 with a reckless on your record, plus 3 years of SR22 insurance. Be prepared to pay 400+/month for insurance for the next 3 years.

Like anon said, lawyer up, and expect to pay 5k+, every dollar will be worth it.
>>
>>14793505
There were no signs saying I can't pass on right and the person in the left lane was only going 70. If I was late to my job at Cracker Barrel I would have gotten fired. I really didn't have any other option.
>>
>>14793522
You could have left for work earlier. You need to learn the rules of the road. You don't pass on the right. You pass in the left lane. Law states "Keep right except when passing." You can flash your lights and wait for people to move over, or you can continue at the rate of speed. I don't care how you look at this, you need to drop the victim attitude.
>>
>>14793522
leave earlier? you realize this is the kind of thing you have to put on job applications under "have you ever been arrested" right?

this isnt a ticket dude.
>>
>>14793537
You sound like a little whiny bitch. Anyone that doesn't drive like a pussy have advice on what I should do? I have noted the lawyer thing, but I have very little money so IDK.
>>
>>14793522

>>14793537

Seriously, hit google, find a traffic lawyer in your area with a good reputation, call him tomorrow, and find out what his retainer fee is, and pay it to get him started on your case. You didn't get a ticket, you got a criminal summons. Reckless driving is a class 2 misdemeanor most states. Think I am bullshitting?

http://tonyrollmanlaw.com/traffic-crimes/speeding/

"In North Carolina, if you are caught driving at least 15 miles per hour over the speed limit in a location where the speed limit is less than 55 miles per hour you can be charged with reckless driving, and any speed over 75 mph can carry a charge of reckless driving as well.

Under North Carolina law, reckless driving is a class 2 misdemeanor, which is punishable by up to 60 days in jail. A conviction for reckless driving carries 4 points on your driver’s record, and up to one year suspension of your driving privilege. Fines and driving courses can exceed $1,000, and your insurance company will rate you as a bad risk for years in the future, costing hundreds of dollars more a year."

If you are seriously lucky, and he has a good relationship with the traffic judge in your area, your wallet might not get fucked too bad if he can plead you to regular speeding and send your ass to traffic school.
>>
>>14793552
enjoy your SR22 and criminal misdemeaner conviction then. probably time to find money for a lawyer
>>
>>14793552
It's pretty much get it reduced with a lawyer or start reading up on traffic court defense and try to get it extended out to the point that they are willing to reduce it since it's been an on going case for so long and you went to traffic school in the meantime, or they decide to fuck you anyway and you have to pay insane insurance rates to drive any vehicle for the next 7 years.
>>
>>14793552
A whiny little bitch? The answer is "leave earlier." I drive a 650hp car, and have 0 accidents and 0 tickets, because I know how to drive. I take preventative measures, I leave on time, I have fun in safe places, and don't blame other people when I fuck up.

You need a damn good lawyer or you're fucked. Your other option is walking for the next 3 years. Nobody here has a magic bullet. You fucked up. There were a lot of things you should have done differently, and didn't. At this point, you have several options.

1. Nolo contendere
2. Represent yourself, and lose
3. Get a public defender, probably get one of the charges lessened, and still end up mega-fucked
4. Hire a damn good lawyer, and likely get this reduced to a speeding ticket.

Nobody here is going to give you some magical advice about some magic phrase you can walk into court and scream at the judge to have him drop the ticket.
>>
>>14793552
You got a criminal summons, so see >>14793558

YOU can't do shit in court, other than show up and get the book thrown at you. This isn't a fucking speeding ticket, typical shit associated with that won't work

>>14793561
Won't work with reckless driving, as it is a criminal summons, not a traffic violation. reckless driving is treated on the same level as a DUI in most states, you won't get it thrown out or reduced by trying to get it extended forever
>>
>>14793558
Not going to read anything from a tripfag

>>14793560
Everyone else was driving the same speed as me, since the cop only pulled me over and not everyone else it's the definition of profiling. I'm going to look for lawyers that will work probono for profiling cases, looking into it now.
>>
>>14793507
Where I am, we have, arrest, stop and book/release. Arrest implies you were at least held for a bit.
you also get your fingerprints taken if you were arrested.
Also what do you consider arrested? If you are arrested there is a record.

>>

the tripfag gave you the only real advice. You're either trolling or a dumbass. 50/50 shot for which
>>
>>14793574
I wouldn't waste a second of my time on that. You're goddamn right they were profiling you. You're a kid driving too fast. I'd profile the shit of you too. You need to lose the whole "everyone else was doing it! It wasn't my fault!" bullshit. The judge doesn't fucking care.

The first thing you need to know about the legal system (this is criminal, not a speeding ticket, get it straight) is that they don't give a fuck, and will throw the book at you. They don't owe you shit. The legal system sucks and isn't fair. It's designed to fuck you. It is a mega-uphill battle that only the best equipped lawyers stand a minute chance of contending with. I was doing 37 in a 30 and got hit with a reckless driving and paid $6k to fight it. Was it fair? Fuck no. But that's life. Get ready to bend over.

>>
>>14793612
Why didn't you pick 76?
>>
>>14793424
I had my radar detector on. No way he knew exactly how fast I was going. Would a lawyer get these reduced or should I admit guilt, although I was never driving stupid enough to hit another car, I am very careful about that. I'm honestly surprised about both charges. I never endangered anybody, I never "almost" hit a car or anything of that sort.

>>14793432
Wasn't arrested. I got money for the court fee $200.

>>14793447
I completely understand the charges and consequences but I think the cop exaggerated about almost hitting cars and driving "recklessly". I was never close enough to be brake checked or swerve into another lane and swipe a car.

>>14793458
Cop just greeted me for my license/insurance and then returned with my ticket and told me to drive safely. No other words exchanged.

>>14793463
I don't have $6k, $1,000.

>>14793574
Is funny but it isn't me.

Extended pic of citation as proof.

What are the chances that I could get this reduced as speeding? Is reckless driving a definite? I was passing cars in the right lane but not endangering anybody. Not close enough to be brake checked either, by far.
>>
>>14793581
this is a criminal offense. you are arrested when you commit a criminal offense irregardless of whether you go to jail or not.
>ive been arrested and released from the back of a cop car with a summons for a gross misdemeaner no fingerprints no jail
sorry bucko, thats how it is in most of the US
>>
>>14793612
I got pulled for doing around 75 in a 55 in a straight road with only one other car around. Quote the trooper dickhead that was in the opposite lane and turned around, went well over the limit to chase me down and pull me:
>I had to pass several cars to get to you.
He also pinned me for 83mph.
>>
>>14793617
yes, that is called being arrested dumbass
jail=/= arrested
>>
>>14793633
>irregardless
the fuck

no you're not arrested dipshit, you're summoned to court where they empty out your pockets
>>
>>14793632

A decent lawyer should be able to get it reduced. I got a willful and wanton reckless driving ticket when I was 16. My dad talked to the bailiff who spoke to the judge and I ended up with traffic school. That said, my dad was a LEO and I was underage.
>>
>>14793632
"post arrest complaint"

can u read? u were arrested, given a summons, and released. all while in ur drivers seat.

say it with me. criminal. misdemeanor.
>>
>>14793632
A lawyer has a better shot of getting it reduced. He'll probably extend it first thing so you can take a traffic class, once he gets a date with one of his buddy judges, he'll present a whole bunch of his cases at once and have them all reduced in succession most likely.

At least that's how it worked last time I needed a lawyer for driving offenses.
>>
>>14793632
>I had my radar detector on. No way he knew exactly how fast I was going.

So? Why would having your radar detector on mean anything in terms of him clocking your speed? It doesn't make the radar/lidar system in his patrol car any less effective. I have an Escort 9500ix myself.

And yes, the entire point of getting a lawyer would be for him to reduce/plead you out. Never admit guilt to anything
>>
>>14793649
>What happens when someone is arrested?

Cite & Release:
For a person with arrested for a minor offense, and little or no criminal history, the officer may write you a ticket and release you. The ticket will have the charge he is citing you for and a date, time and court house to appear at. The charge on the ticket may not be the charge filed against you in court. A deputy district attorney will review the police report and decide the actual charges filed against you.

You will not be cited and released if charged with domestic violence, arrested by the California Highway Patrol [CHP] for driving under the influence [DUI], arrested for a DUI when you have had a prior DUI, or when you are arrested on a felony.

They are claiming that cite and release is arrested.

Here's my 650hp M3.

I don't really give a fuck what you do or don't believe. You're delusional if you think I drive 2mpg under the speed limit. I take preventative measures, like a hard wired radar detector, LIDAR jammer, etc. You should be listening to the advice in this thread. You came here to figure out what you should do. Guess what? I, and many others have been through this. You've been given the answers. Find a damn good lawyer, ask specific questions if you want, but you're on the hook for this. Your actions=your responsibility.
>>
>>14793659
because cite and release is arrested. first sentence mate.

yes, you can be arrested without leaving your car
>>
>>14793656
If you actually had a radar detector on, this didn't have much to do with speed. Also, he can pace you and estimate. Sucks, doesn't it? This is about your reckless swerving, sudden lane changes, and following too close.
>>
>>14793674

He said that I was going faster than 65. He didn't clock me in at 75, 80, 90, etc. anything like that. That has to work to my benefit though right? And he got me on video according to the ticket.

I used my turn signals every lane change too. Will this be important? It wasn't like I was swerving and cutting cars off and almost giving them a heart attack. I used my turn signals, but not sure if that will do anything.

Pic related is a friend's ticket a few months ago.

>>
>>14793709
You didn't get charged with speeding so it's unlikely that those things will factor in to the equation, plus it's basically your word vs the officers.

You may, if you have a really excellent lawyer, get the charge reduced to 'Improper operation of equipment' or some bullshit, which is the best case scenario you can hope for.

More than likely you'll have to pay a speeding fine and court costs and your lawyer, etc.
>>
>>14793709
First of all, swerving through traffic, regardless of using your turn signals IS dangerous. No, it doesn't matter that you signaled. The judge believes the police officers version of events, and watches the video. He sees you swerving through traffic and you're toast. Whatever story you tell doesn't matter. They won't listen, and won't care. Clock speed doesn't matter here, he's not basing the criminal charge off the speed, it's based off your driving. There are laws about how frequently you're allowed to change lanes, and you clearly weren't obeying them. Look them up in your state. That's your best bet. A lot of these laws are purposefully written to be extremely vague. For example, reckless driving in my state is defined as "Willful and wanton disregard of persons and property." Who's to say you had wanton disregard of persons? A judge is.
>>
>>14793722

>>
>>14793765
Are you fucked? It's really in your hands. If you plead guilty, yes, you are fucked. What will happen if you plead guilty/lose on all charges:

1. Your insurance skyrockets. Think 400/month for the next 3-5 years.
2. You get a criminal charge, and in extreme cases, could go to jail, it typically carries a mandatory 30+ day license suspension, and fines.
3. You get 3-5 points for insurance companies.

So yes, if you lose, you're fucked.

If I were in your shoes, this would be my course of action.

Go to the court date, ask for the longest extension possible. Try for 6 months, and see what the judge counters with.

Get a public defender, they're typically cheap, and if you can prove low-income, it could be as little as $50.

Work with the public defender, take the case to resolution, and weigh your options. If you get a favorable outcome, take the deal. It will probably be something like "improper lane change" and/or other charges.

If you don't like the outcome, fire your public defender, continue out the case, and get a better lawyer.

>>
>>14793836
They write you for the absolute maximum they're able to. The charges go to the county prosecutor, who evaluates the evidence, and decides which charges to move forward with. It's unlikely that a prosecutor will drop any of the charges. It's up to you to fight it. They know you should have gotten improper lane change and speeding, so they write you for much harsher charges, and know you'll plead down to those, as well as cost you a ton of money. Welcome to the legal system.
>>
>>14793836
This is the way the law works. By the letter they can rape you up the ass for very little, but are mostly content to just give you fines so you don't notice how inane the rules are.
>>
>>14793846
Honestly what I think too. I don't like to be mean, I just may be salty atm, but the cop was a short and fat prick. He looked like a typical bitch ass cop and I don't normally have anything against cops but he looked like he had no mercy and no problem sleeping at night after giving out ridiculous charges.

>>14793873
>>14793874
Yeah I am afraid it will be a tough battle but my parents know a good lawyer that they can call tomorrow. I don't have thousands of dollars to pay like some people in this thread suggested. I can pay the court fee and any lawyer fees as long as they're not insane rates.

Reckless driving in Kentucky is defined as driving without content for other people but that is untrue. I used turn signals and didn't cut people off. I speeded and passed slow cars in the left lane.

I have to get up in 5 hours for work but I appreciate everybody's advice in the thread. Thank you all.

There is a possibility that the officer won't show up to the court, in which case you can just plead not guilty, but that's a huge gamble.

Sorry about your situation man, really. Just makes me all the more grateful that I didn't get a ticket when I was pulled over for speeding.

>>
>>14793873
Wait why improper lane change? OP claims his blinker was on.

I'm so glad this isn't a thing here (Canada). Criminal charges for driving offenses are bullshit. The four "big ticket" items that you can get pinched for are:

>excessive speeding
If you're going in a straight line, doesn't matter how fast, this is the worst offence you'll get. It's just a traffic violation. Fines up to $750 though, and they can impound your car for 7 or 30 days if they feel like it.

>stunting
Also just a traffic violation. Doing burnouts, doughnuts, etc. Basically anything that makes other drivers say WTF. Optional impound for 7 days.

>driving without due care
The worst traffic violation you can get, and optionally a criminal charge. You have to fuck up really really badly though. Like if you're street racing and hit a pedestrian. It's horribly difficult for them to make it a criminal charge though, basically you have to hurt people and they have to prove you did it intentionally. Probably an impound, optional license suspension.

You fucking retard, rule #1 is to not pass a cop who's doing the speed limit, and then after you break that you go and tailgate someone and pass on the right? Is your IQ above 40? Man, I hope you blow all your money on a lawyer then lose and have to pay the fat ticket anyway, that's what your dumb ass deserves. I hope your shitbox gets impounded and crushed. People as stupid as you shouldn't be allowed on the roads. You should be taken out and shot for being this dumb, you singlehandedly drive down the average national intelligence with how dumb you are. Let this be a lesson, moron.
