I'd go with that 530 if it's sturdy.
You absolutely want something with a service history and preferably low kms, I have a E39 525i M Sport and mine despite being an excellent example when I bought it, it's needed 4k (AUD) in the last year to bring it mostly up to standard, so just be wary.
In saying that theyre great cars and will rarely if ever let you down, preventative maintenance is what will run up your bills. But yeah, service history is integral, high kms dont matter too much if it's been looked after you just might need to replace more. Also 530 will hold value much better than the 528 anyway.

I will vouch for 530 quality. I drove a 2003 for a year that had 180k on it. Still drove better than my girlfriends's 2015 Outback and was bone dry.

second, once you have it, look first and foremost for a cooling system overhaul with completely non-OEM parts, OEM means you're inevitably gonna have to do it again
the next three things aren't huge issues but use them to haggle the price down
>pixelated instrument cluster and dashboard
>rust at jack points
VANOS rebuild is a nice bonus but it probably won't have been done, just make sure it's done once you get it

Other misc shit:
Check for responsive locking/unlocking of doors. Slow response on a door means the actuator is beginning to fail.
Check the throttle response. If it's not responding the instant you touch the pedal, it probably needs a fuel filter and maybe a pump. You should be able to find this on the service record if the owner/their mechanic was good about maintaining them but everybody always neglects the fuel filter and E39s are at the age where they basically all need fuel pumps. Do this yourself once you get it too, it's easy and it's a good introduction to working on your car.

The prices make me slightly suspicious so definitely get a mobile mechanic to come inspect it or take it to a shop to have it checked out before you buy it.

don't get fixated on price for the mileage, that isn't important with an e39, because it's far more expensive to buy one that wasn't taken care of. $500 more in price is $2000 less in extra maintenance you need to make up for

You probably can buy it and drive away with it. Some things might just break sooner than later if the right things haven't been done and without good service records or a proper inspection you won't be aware of potential upcoming issues.
These vehicles are reliable as fuck but there are a few things that really have to be done. None of them are catastrophic, it's just annoying when you buy a car and the water pump fails a month later because the previous owner didn't get it replaced preventatively and you have to get a tow.
