Say you had a song with a melody that is mostly a descending diatonic mode like the start of this for example

How similar would another songs melody have to be to this to be considered "fishy" even if its still mostly just a descending mode ( dorian in this case)
know any other songs that have a similar descending melody?
Will we even run out of diatonic melodies?

Very. I'm no copyright lawyer, but melody is just one of the factors that make up a song's identity. The instrumentation and rhythm would also have to be similar, for example.

I don't think so. Of course there is a theoretical limit on the number of diatonic note combinations that could be considered a 'melody', but the other formal aspects of composition and arrangement, and the way different music genres use melody, make for effectively endless variation.

Some melodies are just reaaaaaally common, I think the whole instrumentation of the song changes things a lot.
Just playing the same notes on a different instrument and with a different intonation makes something almost completely new for me
