Stella is an abused person that had literally had her choices in life taken away from her. She's had her mind played with and her body altered. The EA uses her as a machine for killing, and all anyone on the ship can see her as is a thing to be studied, rather than a person abused by the EA.
For all of the character's bluster, Shinn sees her as what she is, and made the admittedly foolish idea of trying to see to it that she doesn't die a labrat or a dog's death
He called over Neo hoping that he would have some compassion for his fellow man left in him to leave her at peace.

And even if Stella had rolled over and died, they had Sting waiting on the wings. If we're going to accuse Shinn of a crime, then it's freeing an enemy pilot, not participating in the burning of Berlin. That's something that was going to happen even if Stella was there or not.
Athrun could have played his cards in various ways that wouldn't have him on the run, even if he was thinking "man, fuck Gilbert". Merin didn't have to go with Athrun to do anything, she made her choice at that split second.

Watching Shinn deal with Stella, I got a sense of genuine compassion out of him. More than I ever got out of all of Kira and Lacus's pretentious dialogue.

Shinn killed Auel (after already working out that he was Extended) and he kills Sting when he returns in a Destroy. He doesn't think he's an Extended unlike with Auel but since the only Destroy pilot known was Stella you'd think he'd guess that too.
And then he brutally kills them and is pleased with himself about it, even though he gave a long speech to Athrun about how the Extended are innocent, which he only seems to apply to Stella.
