The United States is not bound by the restrictions of the Geneva Convention, which we never signed, but we are bound by the restrictions of the Hague Convention.
On top of that, any NATO country openly using a material banned by NATO is inviting both repercussions on itself from the UN (which America may be above) and has opened the door for other countries to use such weapons with precedent.
So overall, unless it's some real top secret shit, the US is not pumping Agent Orange into the air anytime.
