They laid claim to the entire South China Sea, of course no independent court was going to rule in their favor.

That's why Beijing said they would ignore the ruling from the very beginning. That's not going to change.

Chinese knew from the start they will lose

That's why they refused to argue their case and select one of the judges in the tribunal

Court's then-president, who is Japanese, had to select him instead.

China is also complaining that majority of judges ruling on the case were European.

Both China and the Philippines are signatories to the UN charter which established the International Tribunal for the Law of the Sea.

China's claim on the Nine Dash Line is weaker now. They can no longer even pretend that they respect international law.

No, this ruling is going to have an impact on China's disputes with other nations in South China Sea with which they have disputes.

New Philippine president, Duterte, wants to initiate multilateral talks with China because he would like Chinese investments and loans.

Why? Russia annexed Crimea and used to rule over Eastern Europe, that's where the fear comes from.

China has never once in its history successfully occupied a SEA nation. ASEAN countries have been at war with each other longer than they've been at war with China.

And except for Thailand, all of them have been colonized by Western empires. And Thais have nothing to gain from cockblocking China, we have no claims in the South China Sea.

The Chinese in general argue that they have been sailing these waters with blue-water capable ships earlier than all SEA countries even built their first fishing boats larger than buckets, and that they have been using these islands as navigational aids for centuries.

These islands in the SCS got silently taken over by the SEA countries during Chinese civil war and other periods of Chinese weakness, which ended up with them losing most of their previous holdings.

>>61991094
What will be interesting now, is how Taiwan would use the ruling about Itu Aba to complain about Okinotorishima. Since Itu Aba now isnt considered as an Island that can generate an EEZ, even with people living there and with economic activity, Okinotorishima, which really is just a rock in the water with no people living there, also shouldnt generate EEZ anymore.

http://thediplomat.com/2016/07/of-course-china-like-all-great-powers-will-ignore-an-international-legal-verdict/

Nothing will happen. China, just like the US and UK before, ignore PCA rulings

Though, the wording of the ruling isnt really as clear cut as portrayed by BBC; the last part of the full press release:

>"Finally, the Tribunal considered the Philippines’ request for a declaration that, going forward, China shall respect the rights and freedoms of the Philippines and comply with its duties under the Convention. In this respect, the Tribunal noted that both the Philippines and China have repeatedly accepted that the Convention and general obligations of good faith define and regulate their conduct. The Tribunal considered that the root of the disputes at issue in this arbitration lies not in any intention on the part of China or the Philippines to infringe on the legal rights of the other, but rather in fundamentally different understandings of their respective rights under the Convention in the waters of the South China Sea. The Tribunal recalled that it is a fundamental principle of international law that bad faith is not presumed and noted that Article 11 of Annex VII provides that the “award . . . shall be complied with by the parties to the dispute.” The Tribunal therefore considered that no further declaration was necessary."

tl;dr

"no further declaration was necessary" means that the status quo remains and both claimants should 'respect each other'.

China's and the Philippine's pretty quiet reaction is therefore understandable

A better article about this case:

http://www.straitstimes.com/asia/se-asia/no-legal-basis-for-china-to-claim-historic-rights-to-resources-in-sea-areas-within-nine

>The Philippines said those concerned must exercise sobriety and restraint.

>“Our experts are studying this award with the care and thoroughness that this significant arbitral outcome deserves,” Foreign Affairs Secretary Perfecto Yasay told a news conference.

I don't think many people in the UK, France or the Netherlands think that imperialism was good.

Every child would tell you immediately, upon comparing Okinotorishima with Itu Abe, that Itu Aba is a proper island. On Okinotori, the concrete "rock" isnt even natural origin.

I think Japan shouldnt be too happy about that ruling, as Taiwan and China will now use this precedence to file a complain against the Japanese EEZ claim about their artificial rock.

Because the USA actually has its people living on Guam. Guam can naturally support life, it can provide food and water to a certain extent. It has a permanent population.

The SCS case, while having nothing to do with Japan, sets a legal precedent for future potential court rulings.

What the German is trying to tell you, is that today's SCS ruling states that Itu Aba Island is a "rock", and therefore cannot extend a country's EEZ. However, Japan uses Okinotori to extend Japanese EEZ.
>>

>le russia boogeyman
Come on now, it's not the 80s anymore
>>
>>61992440
It literally has everything to do with that.

Philippines argued against the Taiwan occupied Itu Aba, stating that is was merely a rock and not an Island, and as such, cant generate any EEZ. Now, the verdict confirms this argument.
But same argument is made by Taiwan against Japan's Okinotori, which is actually looking like an uninhabitated rock and is a far cry from the habitable island-like entitiy that is Itu Aba.

And the fact that Taiwanese fishermen were abducted and fined by the Japanese when they fished in the waters around that Japanese occupied rock, Taiwan now can use that verdict against Itu Aba to file an complain about Okinotori as well, as a precedence is now set in stone.

Japan should prepare to pay compensations and do apologies again.

I already said. where is definition of "rock" written in the law? new information added in it today?
>>
>>61992440
>Spratly Islands had nothing like "rock"
There is a island within the Spratlys called "Itu Aba", and it is currently owned by Taiwan. It is the biggest island within the Spratly Islands.

According to the Hague, Itu Aba is not an island, it is a rock. However, Japan claims that Okinotorishima is an island, even though it is much smaller than Itu Aba, and is below sea level at high tide.

So, Mr. Nippon. Do you think Okinotorishima is an island, or a rock? If it is an island, it makes Japan's waters bigger. If it is a rock, it makes Japan's waters smaller.

Where did I say that the definition of "rock" changed in law? Where? Point it to me. Where did I say that?

I said that there is now a legal precedent (先例, 判例) from this case which affects future cases. Based on the SCS ruling, China can argue that Okinotori is not an island, and therefore decrease the size of Japan's EEZ waters.

Daily reminder: China lost again, so stop pathetic pro-China shitposts, thank you!

A 2016 Harvard University paper found that in contrast to common assumptions, Chinese internet commentators are mostly paid government bureaucrats, responding to government directives in times of crisis, and flood Chinese social media with pro-government comments. They also rarely engage in direct arguments, and around 80% of the analyzed posts involve pro-China cheerleading with inspirational slogans, and 13% involve general praise and suggestions on governmental policies.

As of 2016, this practice seems to have largely ceased, and propagandist participation in Internet discussions has become part of the Communist party officials' normal work. Also the nature of participation has become more nuanced and less aggressive. Research indicated a "massive secretive operation" to fill China's internet with propaganda has resulted in some 488 million posts carried out by fake social media accounts, out of the 80 billion posts generated on Chinese social media. To maximize their influence, their pro-government comments are made largely during times of intense online debate, and when online protests have a possibility of transforming into real life actions.

I think we should all calm down, as the verdict actually doesnt change any facts on the ground:

Tribunal just said that it does not recognise the 200mile EEZ for the artificial islands, but said absolutely nothing about what to do with the man-made islands. The tribunal just said that BOTH China and Philippines has historical rights to fish there.

In the end, it wasnt all that of a happy ending for the Philippines, because their original aim was to have a legal basis to chase out the Chinese from the SCS. But the trial didnt actually say this.

According to WP:
https://en.wikipedia.org/wiki/Okinotorishima

>The waters around the reefs are potentially rich in oil and other mineral and fisheries resources and it lies in an area of potential military significance. At high tide, one area of the reefs is 1.58 square meters (17.0 square feet), roughly the size of a twin bed, and pokes just 7.4 centimetres (2.9 inches) out of the ocean. The other is 7.86 square meters (84.6 square feet), the size of a small bedroom, and rises 16 centimetres (6.3 inches), about twice as high. The entire reef consists of approximately 7.8 square kilometers (3.0 sq mi), most of which is submerged even at low tide.

In simple words: Normally, the "island" is 1.5 metres tall. When the waves are big, the "island" is underwater.

>>
>>61992835
Anyone with half a brain knows this already, you can ignore everyone else.
>>
>>61992825
It is more complicated than that.

The Philippinos were rather muted after the ruling, and no one appears to be happy.
They originally wanted China to be chased out of the disputed regions and ring fence it along with the resources inside the region. The tribunal definitely did not rule in that direction. The tribunal basically ruled for a free-for-all scenario when it specifically says that "both countries should respect each other's rights", as stated in the last part:

>>61991367

By ruling an island the size of Itu Aba as rock, this verdict had just destroyed the claims on SCS by Taiwan, Vietnam, and half of Malaysian claims as they all claim by virtue of existing islands, which had all been ruled as reefs and rocks.

By extrapolating this ruling over UNLOS, this also have serious repercussions on Japan/ Korea conflict on ECS over Dokdo/Takeshima, Taiwan/ Japan conflict over Okinotorishima, PRC/Japan conflict over Socotra Rock etc, as all of those are far smaller than Itu Aba and will now all be considered reefs.

I have never imagined that the PCA can be so stupid. Not only China is going to ignore this ruling, but I will imagine so would most of the SCS claimants plus many more.
