No it's far more complicated than that. During previous parliament. The previous government enacted a Constitutional Court law reform, which was flawed, and since they had majority, decided to choose 5 judges (parliament elects constitutional court judges with simple majority). This law reform was made with politically connected president of the tribunal (or court whichever you prefer). Before taking their offices they have to swear an oath to the president, president had constitutional doubts about this election so he refused to take oath from them.
Now new government in power tried fixing the the failed reform and the ex-government now in opposition complained about fixes and their own law they enacted.
Constitutional court found the reform "partially" (which in itself is ridiculous, because either it is or isn't) unconstitutional, regarding the election of the two judges but not all of them so according to Constitutional court choosing 3 judges was ok. Meanwhile new government passed laws which mandated new election of judges and "fixed" the perceived problems. So new government elected 5 judges and they gave oath to the president. This happened before publication of constitutional tribunal verdict. Since the constitution defines that the court has 15 judges. and now all have been sworn, it's issue about those 3 elected judges, according to opposition. Since the verdicts of tribunal cannot be applied backwards, issues still stands because there is some field to interpretation both sides interpret the law to their merit, and constitutional court is politicized (judges have political connections).
Why is constitutional tribunal so important to current gov, because they can't pass any fundamental reforms, without ex government blocking law changes via politically elected judges, from previous government.
