How do people sell artwork when they use references other people made? (in this case pictures)

I don't actually have experience with this, but I'd say:
-They make sure the ref is free to use without charge
-If it isn't, they contact the author and ask for permission, maybe pay a fee
-They modify the ref in their image a lot, or only use small parts of it, so it couldn't possibly hurt copyright
-They don't

i dont think anyone selling pieces they make dont used references though. it just doesnt make sense to me. Hell even when making a backdrop, where to you get the objects to fill in the scenery?
