he was a phd student at a university at the time. i know most of you don't have this experience, but EVERY phd student gets a talk from the university at the beginning of their program that makes it clear that the work they do at the university belongs to the university.

There's a difference between using someone's code in your project and outright stealing it then claiming it's yours. Open source is not about getting other people's work and claiming it's yours.
