Because FLAC is FOSS and its status as far as IP infringement is unknown. Its sponsors say they won't sue anyone who uses their IP but they won't indemnify anyone against third parties whao may claim that FLAC infringes. See how Microsoft was able to extort all the Android phone makers (apart from, notably, Google) for undisclosed IP infringements.
Microsoft didn't need to go to court; just the threat of litigation was enough.
Once enough people start using FLAC the sharks will gather.
