Firstly, it's not based on Linux. It's closer to BSD, but has bits and pieces from everywhere.
Secondly, they don't sell it (at least not any more), it's a free download (although they do still officially say you're only allowed to use it on their computers.
Thirdly, for all the open source stuff they use, they do release their source. http://www.apple.com/opensource/

It is based on Next/OpenSTEP UNIX with a LOT OF APPLE PROPRIETARY CODE and some Mach research kernel shit and (Free)BSD userland tools thrown together in a big pile of shit.
They can use the stolen/copied BSD stuff and earn money with it because BSD license allows it.
Even Sony does it with the PS4 (Orbis OS is based on FreeBSD9).

OSX is made of BSD, Mach OS, Xerox and NeXT Step OS. It has nothing to do with Linux, just because it has a terminal and from the Unix family.

it's a variant of Unix, and even if it were based on GNU/Linux, you could sell it for money, the only problem would be that you would have to provide source code and build instructions to anybody that owns a copy of the OS, and anybody would be allowed to redistribute it
