It's because the human host is what influences the Spectre. Jim Corrigan is a relic from the 40's that will murder the shit out of an accountant for money laundering but tell the gays to stay at their own bars. When the Spectre has no host and really cuts loose you get shit like Day of Vengeance where he nearly destroys all magic.There's also the problem with plot armor. No one will ever be allowed to kill Joker but at least he got to melt Dr. Light after all the rapes/killings.

That's what I'd be happy with. I understand why they can't do it for huge villains. If you just killed them off the second time you meet them, then you'd be constantly losing interesting characters for the sake of realism.
I feel like Frank Castle should be allowed to kill Z-list Marvel baddies like Snowfire, Griffin, Pink Pearl, Thumbelina or one of the dozen obscure Spider-Man baddies who everyone completely forgot about.
